SAMARTH IVF | PATIENT CONFIDENTIALITY AGREEMENT

Confidentiality Agreement for Website Users

1. Confidential Information: The term “Confidential Information” shall include all information disclosed by the User to the Website, including but not limited to personal details, medical history, fertility records, and any other information provided during the registration process or while using the Website’s services.

2. Purpose: The purpose of this Agreement is to protect the confidentiality of the User’s information and to ensure that such information is not disclosed or used for any unauthorized purposes.

3. Non-Disclosure: The Website operator (Samarth IVF) agrees not to disclose, reveal, or use any Confidential Information of the User for any purpose other than providing the requested services, without the express written consent of the User.

4. Confidentiality Obligations: The Website operator shall take all reasonable measures to maintain the confidentiality of the User’s information, including but not limited to implementing physical, electronic, and procedural safeguards in compliance with applicable healthcare data protection standards.

5. Exceptions: The obligations of confidentiality shall not apply to any information that: (a) is or becomes publicly known through no fault of the Website; (b) is independently developed by the Website without reference to the User’s Confidential Information; (c) is rightfully obtained by the Website from a third party without breach of any confidentiality obligation; or (d) is required to be disclosed by law, regulation, or a valid order of a court or other governmental body (provided that the Website will notify the User promptly of any such required disclosure, where legally permissible).

6. Term: This Agreement shall remain in effect indefinitely from the date of the User’s registration or interaction on the Website, unless terminated earlier by mutual agreement of the Parties.

7. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflicts of law principles. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Chhatrapati Sambhajinagar, Maharashtra.

8. Entire Agreement: This Agreement constitutes the entire agreement between the User and the Website concerning the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.

By continuing to use the website and filling up any forms herewith, the User hereby acknowledges having read and agreed to the terms of this Agreement by using the services provided on the Website.
